Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Exodus website at exodusevac.com or the Exodus mobile application (collectively, the "Service") operated by Exodus ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and a resident of a jurisdiction in which Exodus offers its Service to use Exodus. By using the Service, you represent and warrant that you meet these requirements. Exodus reserves the right to refuse service to anyone for any reason at any time.

2. Description of Service

Exodus is a parametric benefit platform that monitors registered addresses for mandatory evacuation orders. When a qualifying event occurs, eligible subscribers receive automatic benefit payments. Exodus is not an insurance company. Benefits are administered in partnership with licensed insurance carriers and are subject to the terms of the applicable benefit agreement provided at the time of subscription.

3. Subscriptions and Payments

Exodus offers monthly and annual subscription plans. By subscribing, you authorize us to charge your chosen payment method on a recurring basis. All subscription fees are in U.S. dollars. You may cancel your subscription at any time through the app or by contacting support@exodusevac.com. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial periods unless required by applicable law.

4. Waiting Period

A 10-day waiting period applies from the date of subscription. No benefits will be paid for evacuation orders issued during this waiting period. This provision exists to prevent adverse selection and ensure the integrity of the benefit program.

5. Benefit Payments

Upon a qualifying mandatory evacuation order covering your registered address, you will receive an initial payment of $1,000. A second payment of $1,000 will be made upon GPS confirmation that you have physically exited the designated evacuation zone. Payments are made via instant transfer to a Visa or Mastercard debit card on file. Exodus makes no guarantee regarding the timing of payments beyond commercially reasonable efforts. Benefits are subject to the terms and exclusions of the applicable benefit agreement.

6. Accuracy of Information

You agree to provide accurate, current, and complete information when registering and to keep your account information updated. Providing false information, including a false home address, constitutes fraud and may result in immediate termination of your account and forfeiture of any benefits, in addition to any legal remedies available to Exodus.

7. Location Data

To receive the second benefit payment, you must grant the Exodus app permission to access your device's GPS location. Location data is used solely to verify zone exit in connection with a qualifying event. If you revoke location permission, Exodus may be unable to process your second payment automatically and may require alternative verification, which could delay payment.

All content, trademarks, logos, and software associated with the Service are the property of Exodus or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes only.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT EVACUATION ORDER DETECTION WILL BE INSTANTANEOUS OR EXHAUSTIVE IN ALL JURISDICTIONS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EXODUS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL SUBSCRIPTION FEES YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Exodus and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

13. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections 9 through 15 of these Terms survive termination.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Georgia, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction. You waive any right to a jury trial or to participate in a class action.

15. Changes to These Terms

We may update these Terms from time to time. We will provide notice of material changes by updating the effective date above and, where appropriate, by notifying you via email or in-app notification. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
